Terms of Service
These Terms and Conditions constitute a legally binding agreement ("Agreement") made between you (the "Customer") and Gtesim, concerning your access to and use of our website (the http://www.gtesim.com website), mobile application (the Gtesim App), and eSIM data services (the "Service").
You agree that by accessing the Website/Application or purchasing the Service, you have read, understood, and agree to be bound by all of these Terms and Conditions.
1. Our Services
1.1 Gtesim sells prepaid eSIM data plans through the http://www.gtesim.com website and the Gtesim Application.
1.2 Gtesim shall use commercially reasonable efforts to ensure the Service is available to you. However, the Service may be subject to limitations, delays, and other problems inherent in the use of electronic communications and telecommunications networks. Gtesim does not warrant that the Service will be uninterrupted, entirely error-free, or completely secure.
1.3 The quality and coverage of the Service are dependent on the networks of our partner mobile operators. While Gtesim selects its partners with care, it cannot guarantee specific network coverage, data speed, or performance in any particular region or location. In the event of a persistent and material failure of the Service to function in a supported region, your remedies shall be limited to those outlined in the Refund Policy (Section 5).
2.User Registration and Account
2.1 To use the Service, you must register an account by providing accurate and complete information, such as your name and a verifiable email address.
2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.3 You agree to notify Gtesim immediately of any unauthorized use of your account or any other breach of security.
3.Purchase, Activation, and Service Term
3.1 By purchasing the Service, you acknowledge that you have an unlocked, eSIM-compatible device.
3.2 The service contract starts upon your successful purchase of an eSIM data plan.
3.3 You are responsible for downloading the eSIM profile and activating the data plan. A stable internet connection is required for this process.
3.4 The Service will commence upon successful activation and will remain active until the data is fully consumed or the plan validity period expires, whichever comes first.
4.Payment Terms
4.1 All services are prepaid. Payments can be made via credit card or PayPal.
4.2 All prices are stated in US Dollars (USD) and are inclusive of any applicable taxes unless specified otherwise.You are responsible for any additional taxes, duties, or charges imposed by your local jurisdiction.
4.3 All payments are processed securely by our third-party payment processors. Gtesim does not store your full credit card details.
5.Refund Policy
5.1 You may request a refund if the eSIM cannot be activated due to a technical problem originating from Gtesim.All refund requests must be submitted with supporting evidence (e.g., screenshots of error messages) within 48 hours of the activation time or the commencement of the service issue. Gtesim will investigate such requests in good faith.
5.2 Refunds will not be provided after the eSIM has been successfully activated, except as required by applicable law.Refunds will be processed to the original payment method within a reasonable period of time.
5.3 Gtesim credit balance is non-refundable, non-transferable, and cannot be exchanged for cash.
6.User Obligations and Acceptable Use Policy
6.1 You agree to use the Service only for lawful purposes and in accordance with this Agreement.
6.2 You must not use the Service:
- (a)for any abusive, illegal, or fraudulent activity;
- (b)in a way that could impair or damage the network;
- (c)unless expressly authorized by Gtesim;
6.3 In the event of a breach of this section, Gtesim may suspend or terminate your access to the Service immediately and without prior notice.
7.Privacy Policy
Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms, explains how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in our Privacy Policy.
8.Disclaimer and Limitation of Liability
8.1 To the fullest extent permitted by law, Gtesim shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Service.
8.2 Gtesim's total liability to you for any claim shall not exceed the amount you paid for the Service in the six (6) months preceding the claim.
8.3 Gtesim is not liable for service issues caused by factors beyond its reasonable control, including but not limited to:Data transmission interruption due to malfunctioning of the computer rooms or communication networks of telecom carriers;
8.3.1 Interruptions or failures of telecom carriers’ computer systems or communication networks;
8.3.2 Force majeure events such as natural disasters (e.g., typhoons, earthquakes, floods), power outages, wars, or terrorist attacks;
8.3.3 Cyberattacks, hacking, or other malicious activities;
8.3.4 Malfunctions of your device or incompatibility with the Service;
8.3.5 Areas with limited or no signal coverage, such as remote regions, subways, tunnels, basements, mountainous areas, or at sea.
9.Governing Law and Dispute Resolution
9.1 This Agreement shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region.
9.2 Any dispute arising out of or in connection with this Agreement shall be submitted to the exclusive jurisdiction of the courts of Hong Kong Special Administrative Region.
